Websites/brands: this privacy statement applies to the “Invest in Spain” project and related websites/channels operated by Luxe Vastgoed Groep.
1.1 Applicable regulations
We process personal data according to the General Data Protection Regulation (GDPR) and, where applicable, the Spanish supplementary law Ley Orgánica 3/2018 (LOPDGDD).
For electronic commercial communications (such as newsletters), we take into account the Spanish Ley 34/2002 (LSSI-CE).
1.2 Data protection officer (DPO)
We currently have no data protection officer appointed.
2. What do we use personal data for?
We process personal data for the following purposes:
- Information requests and contact
To answer questions, send info about homes, projects, services or investment opportunities. - Mediation and follow-up of applications
If relevant, we can make your application pass on to professional parties within the real estate industry (e.g. brokers, developers or partners) so that you are helped correctly. - Tenders, contracts and services
For quotation preparation, contract execution and administrative follow-up. - User management (if using an account/hidden zone)
Creation and management of accounts and access to protected functions. - Newsletter and updates (if you subscribe)
Send news, updates, new offers, and relevant information. - Improvement, security and operation of the website
For example, server logs, security, debugging and statistics (where IP address can be technically processed).
2.1 Retention periods
We store personal data no longer than necessary for the purpose for which they were collected, taking into account legal obligations.
- Contact and info requests: as long as necessary for follow-up, then a reasonable period at most for administration/archiving.
- Contracts and invoicing: as long as required by law (e.g. tax/accounting retention periods).
- Newsletter: until you get your deregisters or withdraw your consent. Thereafter, we may retain your data blocked for legally required time limits (e.g. to show that you withdrew consent or to handle complaints).
3. Legal basis and what data do we collect?
3.1 Legal basis (why are we allowed to process it?)
Depending on the case, we process data based on:
- Permission (e.g. newsletter subscription, certain forms).
- Necessary for performance of a contract or pre-contractual steps (e.g. offer/request).
- Legal obligation (e.g. invoicing/accounting).
- Legitimate interest (e.g. security of our systems, basic statistics, fraud prevention), always respecting your rights.
3.2 Categories of personal data
Among other things, we may process the following data (depending on what you enter/use):
- Identification data: name, first name, possibly company name
- Contact details: e-mail, phone number, address (if relevant)
- Content of your message/request (e.g. interest in a property/region/budget)
- Technical data: IP address, browser/device data, log data (for security and operation)
4. Security
We take appropriate technical and organisational measures To secure your data against loss, unauthorised access or misuse, taking into account the state of the art and the risk of processing (GDPR Art. 32).
5. Sharing data with third parties
We sell your data not.
We may share your data with:
- Service providers/processors that help us (e.g. hosting, IT, e-mail, CRM), only on our behalf and under contractual agreements.
- Professional real estate parties when necessary to process your application (e.g. broker/developer/partner), for that purpose only.
- Governments/authorities when we are required to do so by law or when requested by a competent authority.
6. International transfer
In principle, we process data within the EEA.
If we do work with suppliers that process (in part) outside the EEA, we will only do so with appropriate safeguards (e.g. Standard Contractual Clauses) as required under the GDPR.
7. Your rights
You have the right to:
- inspection request in your personal data
- leave your details rectify (improve)
- leave your details delete (where possible)
- processing limit
- objection against certain processing operations
- receive or transfer your data (data portability)
- your withdraw consent (if consent is the basis)
7.1 How do you exercise your rights?

Clearly state which right you want to exercise and attach proof of identification (e.g. copy of ID with unnecessary data masked off) so that we can be sure it is you.
7.2 Filing a complaint
You can also complain to a supervisory authority, e.g. the Agencia Española de Protección de Datos (Spain) or your local authority (e.g. in Belgium the Data Protection Authority).
8. Consent for electronic communication (newsletter)
When you subscribe to the newsletter or explicitly tick that you want to receive commercial communications, you give permission To receive messages via e-mail and/or other electronic channels. You can unsubscribe at any time via the unsubscribe link in the emails or by contacting us.
9. Changes to this privacy statement
We may update this privacy statement in the event of changes to our services or when legislation requires it. The most recent version is always posted on our website(s).
